Contact forms and inquiries
When you contact us through a website form or by email, we collect the information you provide, such as your name, email address, telephone number, and message. We use this information to respond to your inquiry, evaluate requests for legal services, communicate with you, and maintain appropriate business records.
Submitting an inquiry does not, by itself, establish an attorney-client relationship. Please do not send Social Security numbers, financial account details, privileged documents, or other sensitive information through a website form or ordinary email unless we have instructed you how to provide it.
Nothing in this policy overrides confidentiality duties or other obligations owed to clients or prospective clients under applicable law and rules of professional conduct.
Comments
Where comments are enabled, we collect the information shown in the comments form, along with the visitor’s IP address and browser user agent string, to help detect spam.
An anonymized string created from your email address, also called a hash, may be provided to the Gravatar service to determine whether you use that service. The Gravatar service privacy policy is available at https://automattic.com/privacy/. After approval of your comment, your profile picture may be visible to the public in the context of your comment.
Comments are public. Do not include confidential legal information or other sensitive personal information in a comment.
Media
If image uploads are available, avoid uploading images containing embedded location data, such as EXIF GPS data. Visitors may be able to download publicly available images and extract embedded location information.
Cookies
Cookies are small files stored by your browser. Depending on the features you use, this website may use cookies for convenience, authentication, display preferences, and security.
Comment cookies
If you leave a comment, you may opt in to saving your name, email address, and website in cookies. These are for your convenience so that you do not need to enter your details again when leaving another comment. These cookies last for one year.
Login and account cookies
If you visit our login page, we set a temporary cookie to determine whether your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in, we set cookies to save your login information and screen display choices. Login cookies last for two days, and screen options cookies last for one year. If you select “Remember Me,” your login persists for two weeks. Logging out removes the login cookies.
If you edit or publish an article, an additional cookie is saved in your browser. This cookie contains no personal data and identifies the post ID of the article you edited. It expires after one day.
Security cookies
Google reCAPTCHA uses a cookie called _GRECAPTCHA when it runs to provide security risk analysis. Additional information appears in the reCAPTCHA and website security section below.
Managing cookies
You can use your browser settings to delete or block cookies. Blocking certain cookies may affect website features, including login functionality and security verification. Where applicable law requires consent for cookies or similar technologies, we obtain that consent before using them.
reCAPTCHA and website security
This site is protected by reCAPTCHA. We use Google reCAPTCHA to help protect our website and forms against spam, automated misuse, fraud, and other abusive activity.
When reCAPTCHA runs, Google processes technical information associated with your visit and interactions to assess security risks. The service also uses the _GRECAPTCHA cookie for risk analysis.
David Maho & Associates P.C. determines the purposes of this processing. Google processes reCAPTCHA Customer Data on our behalf under the applicable Google Cloud terms and Cloud Data Processing Addendum.
Legal basis for security processing
David Maho & Associates P.C. processes security information for our legitimate interests in protecting our website, maintaining secure and reliable communications, and preventing spam, fraud, and automated abuse. Where applicable data protection law requires a legal basis, we rely on these legitimate interests only where the processing is necessary and our interests are not overridden by your rights and freedoms.
Where applicable law requires consent for cookies or similar technologies, we obtain that consent before using them.
Retention of security information
We retain security information only for as long as reasonably necessary to detect and prevent abuse, investigate security incidents, and comply with applicable legal obligations. Retention depends on the nature of the information, the severity and duration of any identified threat, and any applicable legal preservation requirements. When the information is no longer needed, we delete it or render it anonymous in accordance with our retention procedures.
Retention of information processed by Google is also subject to the applicable service terms and data processing arrangements.
If you believe security measures have blocked a legitimate inquiry, contact davidmaholaw@gmail.com.
Embedded content from other websites
Pages and articles on this website may include embedded content, such as videos, images, articles, or calculators. Embedded content from another website behaves in much the same way as if you had visited that website directly.
These third-party websites may collect information about you, use cookies, embed additional tracking technologies, and monitor your interaction with embedded content. This may include associating your interaction with an account if you are logged in to that third-party website.
Please review the privacy notices of the relevant providers for information about their practices.
Who we share your data with
Information may be processed by service providers that support website hosting, email delivery, website administration, and security, to the extent needed to provide those services.
Google processes information through reCAPTCHA as described above. Where enabled, visitor comments may be checked by an automated spam detection service, and an email hash may be sent to Gravatar.
If you request a password reset, your IP address will be included in the reset email.
We may disclose information when required by applicable law or valid legal process, or as lawfully necessary to protect rights, investigate security incidents, or prevent fraud or abuse. Any disclosure remains subject to applicable confidentiality duties and professional obligations.
How long we retain your data
Comments
If you leave a comment, the comment and its metadata are retained indefinitely unless removed. This allows us to recognize and approve follow-up comments instead of holding them in a moderation queue.
Registered user information
For users who register on our website, if registration is available, we store the personal information provided in their user profiles. Users can see, edit, or delete their profile information at any time, except that usernames cannot be changed through the standard profile settings. Website administrators can also see and edit that information.
Inquiries and correspondence
We retain inquiries and related correspondence for as long as reasonably necessary to respond, evaluate a potential engagement, maintain appropriate records, and satisfy applicable legal and professional obligations. Relevant criteria include whether representation follows, whether the information is needed for conflict checks, and whether a legal preservation requirement applies.
Security information
Security information is retained according to the criteria described in the reCAPTCHA and website security section above.
Information relating to an established attorney-client relationship may be subject to separate file-retention requirements, engagement terms, and professional obligations.
What rights you have over your data
If you have an account on this website or have left comments, you can request an exported file of the personal data we hold about you, including information you provided. You can also request deletion of your personal data.
Deletion requests do not include information we are required or otherwise lawfully permitted to retain for administrative, legal, professional, or security purposes.
Depending on your location and applicable law, you may also have rights to access or correct personal information, restrict or object to certain processing, receive portable information, withdraw consent where processing is based on consent, or lodge a complaint with a competent privacy authority. These rights are subject to applicable conditions and exceptions.
To make a privacy request, email davidmaholaw@gmail.com. We may need to verify your identity before fulfilling a request.
Where we send your data
Visitor comments may be checked through an automated spam detection service. Information associated with reCAPTCHA is transmitted to Google for security risk analysis.
Depending on the providers involved, information may be processed in the United States or other countries where those providers operate. Where applicable law imposes requirements on international transfers, those transfers must be handled using the required safeguards.
How we protect information
We use reasonable safeguards designed to protect personal information against unauthorized access, misuse, loss, and disclosure. However, no website, electronic transmission, or storage system can be guaranteed completely secure.
Please contact us before sending sensitive documents so that we can advise you on an appropriate method of delivery.
Changes to this Privacy Policy
We may update this Privacy Policy to reflect changes in our practices, website features, or legal requirements. Updates will appear on this page with a revised date. We will provide additional notice or obtain consent where required by applicable law.
