Terms of Service
Terms of Service
These Terms of Service govern your use of davidmaholaw.com (the “Website”), operated by David Maho & Associates P.C., also referred to as David Maho Law (“the Firm,” “we,” “us,” or “our”).
Please read these Terms before using the Website. If you do not agree to these Terms, please discontinue use of the Website. These Terms concern use of the Website; legal representation is governed by any applicable engagement agreement and professional obligations.
Important legal notice: The Website provides general information and does not provide legal advice. Visiting the Website or submitting an inquiry does not, by itself, establish an attorney-client relationship. Do not send confidential or sensitive information until we have confirmed how you should provide it.
1. General Information; No Legal Advice
Website content is provided for general informational purposes. It is not a substitute for advice from an attorney who has reviewed the facts of your particular situation and the applicable law.
Laws, regulations, court decisions, and procedures change. Information on the Website may not reflect the most recent developments or apply in your jurisdiction. Do not act or refrain from acting solely on the basis of Website content.
2. Attorney-Client Relationship
Accessing the Website, downloading materials, sending email, submitting a contact form, or requesting a consultation does not, by itself, create an attorney-client relationship.
Before accepting a matter, the Firm may need to conduct a conflict check, evaluate the matter, and agree with you on the scope and terms of representation. Do not assume that we represent you or are taking action on your behalf unless we have expressly confirmed that representation.
Nothing in these Terms overrides an existing attorney-client relationship or duties that arise under applicable law or rules of professional conduct.
3. Inquiries and Electronic Communications
For an initial inquiry, provide only the information reasonably necessary for us to identify you, understand the general nature of your request, and contact you. Unless we instruct you otherwise, do not submit Social Security numbers, financial account information, medical records, privileged documents, or other sensitive information through ordinary email or Website forms.
Electronic communications may be delayed, misdirected, intercepted, or affected by technical problems. We cannot guarantee their security or delivery. Sending an inquiry does not guarantee a response or acceptance of your matter.
Any duties owed to prospective clients under applicable law and professional rules remain in effect. These Terms do not require you to waive protections that cannot lawfully be waived.
4. Time-Sensitive Matters and Deadlines
Do not rely on a Website inquiry or email to protect a filing deadline, statute of limitations, hearing date, appeal period, or other time-sensitive right.
Unless we have expressly agreed to represent you in the relevant matter, do not assume that the Firm is monitoring deadlines or taking action to preserve your rights. Promptly seek legal assistance when a deadline may apply.
5. Jurisdiction and Availability of Services
The availability of legal services depends on the jurisdiction, the nature of the matter, attorney authorization to practice, conflicts of interest, and the Firm’s acceptance of the engagement.
The Website is not intended to solicit or provide legal services where doing so would violate applicable law or professional rules. Website accessibility in a location does not mean that the Firm offers legal representation there.
6. Attorney Advertising and Results
Portions of this Website may constitute attorney advertising. Prior results do not guarantee a similar outcome.
Each legal matter depends on its own facts, applicable law, and other circumstances. Descriptions of services, experience, outcomes, or testimonials, if displayed, do not promise or guarantee any result in your matter.
7. Consultations, Fees, and Engagement Terms
Any reference to a free consultation concerns an initial consultation offered by the Firm, subject to availability and confirmation. It does not mean that legal representation or additional services are free.
Fees, expenses, payment arrangements, and the scope of any legal services will be addressed separately in the applicable engagement agreement and disclosures required by law. General Website descriptions do not modify an engagement agreement.
8. Forms, Downloads, and Calculators
Forms, sample documents, articles, calculators, and other resources available through the Website are provided for general convenience. They may not be appropriate, complete, or current for your circumstances.
Do not sign, file, record, or rely on a legal form without obtaining advice appropriate to your situation. Using a form does not create an attorney-client relationship.
Mortgage and other financial calculations are estimates. They may omit taxes, insurance, fees, lender requirements, and other costs. They are not loan offers, financing commitments, or guarantees of payment amounts.
9. Website Security and Acceptable Use
This site is protected by reCAPTCHA.
We use security measures, including Google reCAPTCHA, to help protect our website against spam, fraud, automated misuse, and other abusive activity. You must not bypass or interfere with these measures or use this website to submit malicious, fraudulent, or abusive content.
You agree not to:
- Use the Website for unlawful, fraudulent, threatening, harassing, or abusive purposes.
- Submit malicious code, spam, or deliberately false or misleading inquiries.
- Attempt unauthorized access to the Website, its systems, or information belonging to others.
- Bypass security controls or interfere with the Website’s operation or availability.
- Use automated tools in a way that disrupts the Website, circumvents access restrictions, or unlawfully collects personal information.
- Infringe intellectual property, privacy, or other legal rights.
We may require additional verification or restrict requests identified as potentially abusive. If you believe a legitimate request has been blocked, contact davidmaholaw@gmail.com.
Details about personal information processed through these security measures appear in our Privacy Policy.
Any restriction of access is subject to applicable law and does not alter obligations arising from an existing attorney-client relationship.
10. Intellectual Property
Except where otherwise indicated, Website content, branding, and design are owned by the Firm or used with permission and are protected by applicable intellectual property laws.
You may view and print reasonable portions for personal, noncommercial reference, retaining ownership notices. Materials expressly made available for download may be used for their stated purpose, subject to any accompanying restrictions.
Other reproduction, distribution, modification, or commercial use requires permission from the applicable rights holder, except as permitted by law. These Terms do not restrict fair use, public-domain materials, or other legally permitted uses.
11. Third-Party Websites and Services
The Website may contain links to or embedded resources from third parties. Their content, availability, security, and practices are outside our control. A link does not necessarily constitute an endorsement.
Your use of third-party websites and services may be governed by their own terms and privacy notices.
12. Website Availability and Disclaimers
To the extent permitted by applicable law, the Website and its general informational materials are provided “as is” and “as available,” without warranties of accuracy, completeness, uninterrupted availability, merchantability, fitness for a particular purpose, or noninfringement.
We may update, suspend, or discontinue Website features and correct content without advance notice. We do not guarantee that the Website will be free of errors, harmful components, or interruptions.
13. Limits Applicable to Website Use
To the extent permitted by applicable law, the Firm is not responsible for losses resulting from reliance on general Website information, Website interruptions, or third-party resources linked through the Website.
These provisions apply only to Website use. Nothing in these Terms limits liability for legal malpractice, waives duties owed to clients or prospective clients, restricts the right to file a disciplinary complaint, or excludes liability or rights that cannot lawfully be limited or excluded.
14. Governing Law
These Website Terms are governed by the laws of the State of New York, except where applicable mandatory law requires otherwise.
Nothing in these Terms overrides applicable rules of professional conduct, court authority, mandatory consumer protections, or terms governing a separate legal engagement.
15. Changes to These Terms
We may revise these Terms by posting an updated version and changing the date above. Revisions apply prospectively from posting unless another effective date is stated. We will provide additional notice or obtain agreement where required by law.
Changes to Website Terms do not, by themselves, amend an existing engagement agreement.
16. General Provisions
If a provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms govern Website use and do not replace a separate engagement agreement. If a conflict concerns legal representation, the engagement agreement and applicable law and professional obligations control.
